VIRGINIA WAR MEMORIAL LIABILITY WAIVER AND RELEASE

BY CHECKING "I AGREE" BELOW,

I ACKNOWLEDGE AND AGREE TO EACH OF THE FOLLOWING:

I HAVE CAREFULLY READ THIS LIABILITY RELEASE IN ITS ENTIRETY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK AGREEMENT AND A LEGAL CONTRACT BETWEEN ME AND THE VIRGINIA WAR MEMORIAL AND THAT IT AFFECTS MY LEGAL RIGHTS. I AM AGREEING TO THIS DOCUMENT OF MY OWN FREE WILL.

I UNDERSTAND THAT AGREEING BELOW CREATES A BINDING CONTRACT, AND DOING SO CONSTITUTES AN ELECTRONIC SIGNATURE THAT IS JUST AS BINDING AS A MANUAL SIGNATURE ON PAPER.

BY AGREEING BELOW, I AM AGREEING TO ACCEPT THE TERMS OF THIS LIABILITY RELEASE.

I UNDERSTAND THAT I MAY NOT RECEIVE ANY SERVICES OR PARTICIPATE IN ANY OF THE K9 VETERANS DAY ACTIVITIES ON-SITE AT THE VIRGINIA WAR MEMORIAL WITHOUT CHECKING THIS BOX.

I have voluntarily applied to participate in programs and activities at the Virginia War Memorial. I am aware that there are inherent risks and hazards involved in activities with and around dogs, and I am voluntarily participating in these activities with knowledge of potential dangers. I am aware that any pet, regardless of training, handling, or environmental circumstance, is capable of biting and I expressly acknowledge the risks therein. I further recognize, acknowledge and agree that it is my sole decision whether to consult with a medical professional and veterinarian prior to my pet's and my participation in any of the K9 Veterans Day programs and activities at the Virginia War Memorial, which the Memorial recommends. I have either done so or have waived such advice and consent, and I accept any and all risks. I further acknowledge that I have obtained all current vaccinations for my pet(s) from a licensed veterinarian. In order to participate in programs and activities, I, being fully informed of such risks and hazards, agree to assume all risks of such occurrences. I am assuming all risk of personal injury, death, or disability to me or my pet(s) that may result from participation, or any damage, loss or theft of any personal property which I may incur. I understand that some local laws and ordinances require pets to be registered and I hereby acknowledge that my pet(s) and the pet(s) of my agents, my family members, my guests and/or invitees have been registered in accordance with local laws.

I understand that I and my pet(s) will be engaging in K9 Veterans Day programs and activities at the Virginia War Memorial, and it is my voluntary and informed decision to release any future lawsuits or claims that I, my family, any agent or my pet(s) may have or may have against the Virginia War Memorial, the Department of Veterans Services, and its affiliates, officers, directors, agents, employees, and licensors as well as the Commonwealth of Virginia, as property owners (collectively, "the Virginia War Memorial"). I hereby expressly agree to release and forever discharge and hold harmless the Virginia War Memorial from any and all liability, claims, demands or causes of action whatsoever arising out of any damage, loss, personal injury, or death to me, my children in charge, or my pet(s), while participating in the K9 Veterans Day programs and activities. I hereby expressly agree that I will indemnify the Virginia War Memorial against any and all liabilities and damages caused by, incurred by or related to any of my guests, agents, family members, invitees and their pet(s). I understand that no agent or employee of the Virginia War Memorial will be responsible to stand watch over the activities of my pet, or others that may be present upon the premises and upon the activities of myself, other event participants, and other invitees. I understand the nature of the event for which I am registering and have read and fully understand this waiver, release and hold harmless agreement. I further understand that any advisements or warnings of the particular risks of this training or service that I subsequently receive will be incorporated by reference into and become a part of this agreement.

I further hereby give to the Virginia War Memorial the right and permission to copyright and use, photographic portraits or pictures of any customer or pet who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition I, hereby release, discharge and agree to save harmless the Virginia War Memorial, from any liability, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
